Terms & Conditions Terms of Service - Wise Excellence 1. Parties Tutor: Wise Excellence (“Tutor”), a sole proprietor/Pty Ltd registered in South Africa, contact: info@wiseexcellence.co.za, +27 76 372 4035. Client: The person contracting the services (if the student is a minor, the parent or legal guardian). 2. Scope of Services Tutor commits to delivering Financial Accounting tutoring tailored to exams and clarity, including lesson planning, materials, support, and feedback. Sessions may be conducted online, in-person, or hybrid, as agreed upon at booking. 3. Session Schedule & Location Sessions are scheduled per mutual agreement, detailing dates, times, and mode of delivery. Online sessions will use platforms like Zoom or Teams; access details will be shared at least 24 hours before the session and agreed upon in advance. 4. Fees, Payment & Invoicing Fees: The quoted standard rate per hour for your chosen tutoring session (or package rates if applicable). Payment: Due before or immediately after the session, via EFT or other agreed methods. Late Payment: A 5% monthly administration fee will apply to overdue payments. 5. Cancellation & Rescheduling Client Cancellations: Notices made ≥24 hours prior to a session are eligible for a full refund or rescheduling. Notices made <24 hours before may incur full session charges. Tutor Cancellations: Tutor will refund or reschedule any canceled sessions promptly. 6. Late Arrival If the student is more than 15 minutes late, the tutor may consider the session canceled and may charge accordingly. If the tutor is late, the session will be extended time-for-time or rescheduled. 7. Obligations Tutor: Arrive prepared and punctual. Provide clear, exam-focused instruction. Maintain confidentiality of client and student information. Client / Student: Arrive prepared, with necessary materials. Provide truthful information about academic needs. Respect tutor’s professional boundaries. 8. No Guarantee of Results While the tutor aims to enhance understanding and performance, no specific grade or outcome can be guaranteed. Efforts are made in good faith and aligned with industry standards. 9. Confidentiality All shared materials, personal data, and session details are confidential and will only be used for tutoring purposes. This aligns with protections under POPIA (Protection of Personal Information Act). 10. Intellectual Property Materials created or provided by the Tutor remain their intellectual property. Clients may use them for personal educational purposes only - reproduction or distribution is prohibited without written consent. 11. Limitation of Liability Tutor liability is limited to the amount of fees paid. The Tutor is not liable for indirect or consequential losses, academic outcomes, or delays outside their control. 12. Termination Either party can terminate the agreement with 7 days’ written notice. Refunds will be prorated for unused paid sessions unless termination results from policy breach. 13. Dispute Resolution Disputes should first be addressed informally via good-faith discussion. If unresolved, disputes will be governed by the laws of South Africa and resolved in the relevant courts. 14. Amendments / Updates Wise Excellence may revise these Terms, effective upon posting on the website with a minimum 7-day notice before they apply to new or continuing clients. 15. Governing Law These Terms are governed by South African law. 16. Acceptance Engagement with or payment for tutoring services implies full acceptance of these Terms. If involving a minor, the parent or guardian must sign or otherwise accept on behalf of the student. 17.
